Terms and Conditions of Carriage
and Limitation of Liability
Maximum Liability:

The amount of any loss or damage for which Up Front Courier Corp. may be liable, whether or not the loss or damage results from gross negligence, shall not exceed $4.41 per kilogram or $2.00 per pound computed on the total weight of the shipment,unless a higher value is declared on the face of the bill of lading or on the web site waybill,but in no event shall such a declared value exceed:

  • For shipments within Ontario, five hundred dollars Canadian, (unless insured).

The claimant agrees that notwithstanding any disclosure of the nature or value of the goods, the amount of any loss or damage, including consequential, incidental or indirect damage, loss of earnings or profits resulting from the loss of or damage to the goods and/or misdelivery, failure to deliver or delay in delivery of the goods, shall not exceed the maximum liability of Up Front Courier Corp.

 

Insurance:

 

Insurance on deliveries is now available at the cost of $3.75 per $100. value. Maximum insurable amount is $5,000.00. For shipments valued at higher amounts please contact our office so arrangements can be made.

 

“At Shipper’s Risk”

 

The following shipments are not well suited to the Up Front Courier Corp. distribution system and are subject to a high risk of damage. For these reasons, these shipments will be accepted for carriage but only at shipper’s risk, i.e. Up Front Courier Corp. is not liable and will not accept claims for any loss that may be sustained due to the loss, damage or delay in the shipment:

  • Glass and ceramics (China, Pottery, etc.
  • Liquids (Paints, Medicines, etc.)
  • Items requiring temperature control
  • Household goods (i.e. privately packaged personal items)
  • Those items that are prohibited but which are tendered to Up Front Courier Corp. and accepted for carriage without Up Front Courier Corp.’s knowledge as to their contents/size/packaging etc.

 “At Shipper’s Risk” shipments accepted into the Up Front Courier Corp. package handling system must travel on a “no-value”, (i.e. non insured) basis.

 

Concealed Damage


Concealed damage must be reported to Up Front Courier Corp. within 48 hours of receipt. Visible damage must be noted on delivery and also reported to Up Front Courier Corp. upon receipt.

 

Parcel Identification

 

It is the responsibility of the shipper to ensure that all parcels picked up on their behalf have proper labelling on them. We cannot be responsible for parcels failing to have these labels.
